Terms of Service

w8t.ai operates w8t coach, a subscription-based AI weight coaching application for web and native app use. The Service is available to users in the United States, United Kingdom, European Union, Australia and globally.

w8t and w8t coach are trademarks. If you have questions about these Terms, contact support@mail.w8t.ai.

By accessing, using or otherwise interacting with w8t coach, including the website, mobile applications, scanner, coach, insights, dashboards, messages, notifications, emails and any other features, you confirm that you have read, understood and agree to be bound by these Terms, our Privacy Policy and any referenced policies.

These Terms apply whether you signed up for a free trial, a paid subscription or are using free features. If you do not agree to these Terms, do not use the Service.

If you are using the Service on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.

You must be at least 18 years old to use w8t coach. By creating an account you confirm you meet this age requirement. w8t coach is not designed or intended for minors, and we do not knowingly accept accounts from anyone under 18.

w8t coach is intended for personal use to help you track weight, food, drinks and barcodes for general wellness purposes. It is not a medical device, does not diagnose conditions and does not replace professional medical advice.

If you are pregnant, recovering from an eating disorder, or managing a medical condition, please consult a qualified health professional before using w8t coach. The Service is not designed for the treatment, diagnosis or management of any medical condition.

w8t coach involves calorie tracking, weight measurement and food logging. These activities can be triggering or harmful for people with, or recovering from, an eating disorder. If you have, are recovering from, or are at risk of an eating disorder, do not use w8t coach unless explicitly recommended and supervised by a qualified clinician.

If you experience signs of disordered eating while using the Service, including obsessive tracking, restrictive eating, guilt about food, anxiety around meals or significant unintended weight loss, stop using the Service and seek professional support.

To use w8t coach you create an account using your email address. We use secure email-code sign-in instead of passwords. You are responsible for keeping your email account secure.

You can delete your account at any time from Settings → Account → Delete account, or request deletion at https://w8t.ai/delete-account. After deletion, your weight history, scans and progress are removed within 30 days, except where retention is required for tax or legal purposes.

w8t coach is a paid subscription service. Pricing is shown in your local currency, automatically detected based on your location.

New users get a 3-day free trial. During your trial you have full access to all included features. The trial ends 72 hours after your subscription begins.

When your trial ends, your subscription automatically begins and your payment method is charged for the plan you selected unless you cancel before the trial ends. After your initial subscription period, your subscription renews for the same period unless cancelled before renewal.

• Web subscriptions can be managed in w8t coach account billing.
• App Store subscriptions are managed through Apple ID subscription settings.
• Subscriptions purchased through another app store are managed through that store's subscription settings.

Refunds depend on where you subscribed. Web billing is handled through w8t coach account billing. Refund requests for App Store purchases are handled by Apple.

• United States: discretionary refund within 14 days of the first paid web charge. Contact membership@mail.w8t.ai.
• United Kingdom: statutory 14-day right to cancel applies to web subscriptions where eligible.
• European Union: statutory 14-day right of withdrawal applies to web subscriptions where eligible.
• Australia: Australian Consumer Law guarantees apply.
• Apple subscribers: refunds are handled by Apple.
• App Store subscribers: refund requests are handled by Apple.
• After 14 days, cancellation prevents future charges but does not refund prior payments.

Your subscription includes a generous daily, monthly and yearly ceiling on actions. An action is counted each time you record a meal, drink or packaged item by photo, barcode or voice.

w8t coach gives you generous daily, monthly and yearly scanner use.

These ceilings keep the service fast, sustainable and fair for everyone, and prevent misuse. If you reach a ceiling, you can wait for the next reset.

These limits are 'up-to' ceilings, not allowances. Each day, each subscription month and each subscription year gives you fresh use, up to the amounts shown above. Unused actions do NOT carry forward - they reset at midnight daily, at the start of each subscription month, and at the start of each subscription year in your local timezone.

We may change these ceilings at any time. We will give reasonable notice only of a change that materially reduces an active paid plan. Automated, scripted or abusive usage may be rate-limited or suspended at any time.

w8t coach uses artificial intelligence to analyze food and drink photos and voice logs after you grant AI data consent. Barcode lookup remains available without AI data consent while it does not send barcode data or images to an AI provider.

Photo and Voice processing returns food names, calorie numbers, macros and review notes. Saved Diary entries keep the editable result, not the original photo or voice recording.

You can revoke AI data consent in Settings. The current provider list and data-handling details are described in our Privacy Policy.

w8t coach provides estimates based on your photos, inputs and AI analysis. Estimates are intended as practical guidance for daily tracking, not as precise measurements.

Exercise calorie calculations

w8t coach calculates exercise calories using activity values from the 2024 Adult Compendium of Physical Activities together with your logged weight and duration.

These calculations are based on published population averages. Actual individual energy expenditure varies.

We do not guarantee weight loss, weight gain, body composition change or any specific health outcome. Results depend on many factors outside the Service, including diet, activity, sleep, individual physiology, medical conditions and your own consistency.

You accept full responsibility for decisions you make based on the Service's outputs, including what you eat, how much you eat, how you exercise and how you interpret calorie, macro or weight figures.

w8t coach is general wellness information. It is not medical advice, not a medical device, not a diagnosis and not a treatment plan.

You agree not to:

• Use w8t coach for any illegal purpose.
• Attempt to access another user's data.
• Use automated tools, bots or scripts to interact with the Service.
• Scrape, crawl, harvest, index, mirror or otherwise extract data from the Service or its outputs through automated means.
• Reverse-engineer, decompile, disassemble or attempt to extract source code, models, prompts or training data from the Service.
• Use the Service to train, fine-tune, evaluate or augment any machine-learning model without written permission.
• Resell, sublicense or commercially exploit the Service without written permission.
• Submit content that is unlawful, harmful, threatening, abusive, harassing, defamatory or otherwise objectionable.

All content, software, design, trademarks and logos in w8t coach are owned by w8t.ai or our licensors.

You retain ownership of your data. We have a limited licence to process your data only to provide the Service.

You may not copy, reproduce, distribute or create derivative works from any part of the Service without written permission.

We may offer promotional codes to specific users. Promotional codes are personal, non-transferable and may have expiry dates or other conditions. Codes obtained from unauthorised sources may be invalidated.

Family Sharing may be supported for purchases made through app stores. Each family member has their own data and account.

Family Sharing is not available for web subscriptions purchased directly through w8t.ai.

We may update, improve or remove features. We may also change these Terms. If we make significant changes, we will let you know by email or in-app notice before the changes take effect.

Continued use of w8t coach after changes means you accept the updated Terms.

To the fullest extent permitted by law, w8t.ai is not liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from or related to your use of w8t coach.

This includes weight-related outcomes, decisions you made based on Service outputs, lost data, lost time, service interruptions, errors or inaccuracies.

In any case, w8t.ai's total aggregate liability to you for any claim relating to the Service will not exceed the amount you paid in subscription fees in the twelve months before the event giving rise to the claim, or US$100, whichever is greater.

To the extent permitted by law, disputes are resolved on an individual basis only and not as part of a class, collective, representative or consolidated proceeding.

Nothing in this section affects consumer protection rights that cannot be excluded by contract.

You agree to indemnify, defend and hold harmless w8t.ai, its directors, officers, employees, contractors and agents from claims, losses, damages, costs and expenses arising from your breach of these Terms, misuse of the Service, decisions you make based on Service outputs, content you submit or violation of law or third-party rights.

w8t.ai is not liable for delay, interruption or failure of the Service caused by events outside our reasonable control, including natural disasters, war, terrorism, civil unrest, government action, regulatory changes, pandemic, internet or telecommunications failures, AI provider outages, cloud infrastructure outages, payment provider outages or third-party service failures.

The Service relies on third-party providers, including categories such as AI processing providers, payment processors, subscription management providers, cloud infrastructure providers, mobile app stores and public nutrition data sources.

w8t.ai is not liable for errors, interruptions, deletion, delay, communications-line failure, theft, destruction or unauthorized access caused by third-party providers. Third-party terms may also apply.

If you obtain w8t coach through the Apple App Store, these Terms are between you and w8t.ai. Apple Inc. is not a party. w8t.ai, not Apple, is responsible for the Service, its content, maintenance, support and warranty claims.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. If you obtain w8t coach through another app store, equivalent provisions may apply under that store's terms.

You can stop using w8t coach at any time by cancelling your subscription and deleting your account from Settings -> Account -> Delete account.

We may suspend or terminate your account, or restrict access to the Service, if you breach these Terms, fail to pay subscription fees or use the Service in a way that creates risk for w8t.ai or other users.

On termination, your subscription ends, your access to the Service ends and we delete account data per our Privacy Policy except where retention is required for tax, legal or fraud-prevention purposes.

For users in the United States, disputes arising from or relating to these Terms or the Service will be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, unless either party seeks small-claims-court relief.

You may opt out of this arbitration agreement by sending written notice to support@mail.w8t.ai within 30 days of first agreeing to these Terms.

For users in the United Kingdom, European Union, Australia, New Zealand and Canada, disputes will be resolved in the courts of Sydney, Australia, except where local consumer protection law gives you the right to bring a claim in your home jurisdiction.

For users in the United States, these Terms are governed by the Federal Arbitration Act and the substantive laws of the state in which you reside. For users outside the United States, these Terms are governed by the laws of New South Wales, Australia.

These Terms, together with the Privacy Policy, Cookies Policy and Refund Policy referenced herein, constitute the entire agreement between you and w8t.ai relating to the Service.

If any provision is found unenforceable, it will be modified to the minimum extent necessary and the remaining provisions continue in full force.

w8t.ai may assign these Terms to a successor entity. You may not assign your rights or obligations without prior written consent.

Our failure to enforce a provision is not a waiver. We may send legal notices by email, in the Service or on the website. Formal legal notices to w8t.ai must be sent to privacy@mail.w8t.ai.

These Terms are written in English. Translations provided for convenience are not legally binding.
